本條款為舒莫 Sumer（以下稱「本公司」）與使用 sumertw.com 網站、影片內容、行程路線、旅遊導遊諮詢及旅行商品之使用者或消費者（以下稱「您」）間之定型化契約條款，依中華民國《消費者保護法》，並參照經濟部公告之《零售業等網路交易定型化契約應記載及不得記載事項》訂定。
一、契約審閱期間
本條款公開於本站，您得於購買付費服務或商品前隨時審閱全部內容，並享有《消費者保護法》第 11-1 條所定之合理審閱期間。本公司不以任何條款剝奪您的審閱權。
二、服務內容
- 免費內容：網站資訊、旅遊影片與公開的行程路線，供個人參考使用。
- 旅遊導遊諮詢：行前規劃與旅途中的即時諮詢。諮詢方式、時段與費用，於您來信洽詢後由雙方以書面（含電子郵件）確認後成立。
- 旅行商品：可下載的行程包等數位內容。上線時，商品內容、價格、付款與交付方式以各商品頁或訂購時的說明為準，並構成本契約之一部分。
本公司於網站、廣告或電子郵件中所載之內容，均為契約之一部分，本公司對您負有不低於其所載內容之義務（《消費者保護法》第 22 條）。
三、資訊性質與旅遊安全
影片與行程路線依本公司實地走訪當時之情況整理。交通時刻、票價、營業時間、天候與當地規定可能變動，出發前請以官方公告為準。本公司不代訂交通、住宿或門票，亦非旅行業者，不承攬旅遊行程；您與第三方業者間之交易，依您與該業者之約定處理。
本公司提供之資訊或諮詢建議如有錯誤，致您受有損害，本公司依法負責；但因不可歸責於本公司之事由（如天災、交通中斷、第三方業者變更）所生之損害，不在此限。
四、付款與發票
付費服務之價格以確認時所載之新臺幣金額為準，含稅與否依當時說明。本公司依法開立發票或收據。
五、解除契約與退款
- 數位內容：可下載之行程包屬非以有形媒介提供之數位內容。依《通訊交易解除權合理例外情事適用準則》第 2 條第 5 款，經您於購買時事先同意並開始提供者，不適用七日內無條件解除契約之規定；購買頁面將清楚告知並取得您的同意。未經同意、或尚未提供下載者，您仍得於收受後七日內解除契約，本公司於收到通知後十五日內全額退款。
- 旅遊導遊諮詢：諮詢開始前，您得隨時取消並取得全額退款。諮詢開始後，依已提供部分之比例計費，退還其餘款項。因本公司事由無法履行者，全額退款。
- 內容有瑕疵或與說明不符時，您得要求補正、更換或退款。
六、智慧財產權
網站、影片、行程路線、文字與圖片之著作權屬本公司或合法授權人所有。您得於個人非營利目的範圍內瀏覽、下載及使用已購買之內容；未經本公司書面同意，不得重製、公開傳輸、轉售或作商業使用。分享時請以連結方式並註明出處。
七、使用者行為
您不得以違法、侵害他人權益或干擾網站運作之方式使用本服務。違反者，本公司得暫停提供服務，並依法請求損害賠償。
八、個人資料
本公司蒐集、處理及利用您的個人資料，依《個人資料保護法》及本站隱私權政策辦理。
九、條款修改
本公司修改本條款時，將於本頁公告並更新日期。修改內容不溯及既往；已成立之交易，適用成立時之條款。如修改對您不利，本公司將於生效前合理期間另行通知。
十、消費爭議處理
如有疑問或爭議，請寄信至 [email protected]，本公司於收到後十五日內回覆處理。您亦得依《消費者保護法》向消費者保護團體、消費者服務中心或地方政府消費者保護官申訴，或申請消費爭議調解。
十一、準據法與管轄法院
本條款以中華民國法律為準據法。因本契約涉訟時，雙方同意以本公司所在地之地方法院為第一審管轄法院；但不排除《消費者保護法》第 47 條或《民事訴訟法》第 436 條之 9 規定之小額訴訟管轄法院之適用。
十二、條款解釋
本條款如有疑義，應為有利於消費者之解釋（《消費者保護法》第 11 條第 2 項）。本條款未約定之事項，依相關法令及誠信原則處理。英文版僅供參考，如與中文版有歧異，以中文版為準。
Terms of Service (English)
Last updated: October 10, 2026. This English version is provided for reference; the Chinese version above prevails in case of any inconsistency.
These Terms are the standard-form contract between Sumer (舒莫, "we") and anyone who uses sumertw.com, our videos, itinerary routes, travel-guide consultation or travel products ("you"). They follow the Consumer Protection Act of Taiwan (R.O.C.) and the Ministry of Economic Affairs' mandatory and prohibited provisions for standard-form contracts in online retail transactions.
1. Review period. These Terms are published on this site so you can review them in full at any time before buying, with the reasonable review period provided by Article 11-1 of the Consumer Protection Act.
2. Services. Website information, travel videos and published routes are free for personal reference. Travel-guide consultation is arranged by email; the format, timing and fee are confirmed in writing before the service starts. Purchasable travel products (such as downloadable itinerary packs) are described, priced and delivered as stated on each product page. What we state on this site, in ads or by email forms part of the contract.
3. Nature of information. Videos and routes reflect conditions when we visited. Timetables, fares, opening hours, weather and local rules change, so check official sources before you travel. We are not a travel agency and do not book transport, lodging or tickets; dealings with third-party operators are governed by your agreement with them. We are liable under the law for loss caused by errors in our information or advice, but not for events outside our control.
4. Payment. Prices are in New Taiwan dollars as stated at confirmation. We issue invoices or receipts as required by law.
5. Cancellation and refunds. Downloadable digital content is exempt from the seven-day cancellation right only if you agree to this before purchase and delivery begins, as permitted by Taiwan's rules on reasonable exceptions for distance sales; otherwise you may cancel within seven days of receipt and get a full refund within fifteen days. Consultation can be cancelled for a full refund before it starts; after it starts, you pay only for the portion provided. If we cannot perform, or content is defective or not as described, you are entitled to a correction, replacement or refund.
6. Intellectual property. Content on this site belongs to us or our licensors. You may view, download and use purchased content for personal, non-commercial purposes. Do not copy, redistribute, resell or use it commercially without our written consent; when sharing, please link and credit the source.
7. Conduct. Do not use our services unlawfully, infringe others' rights or disrupt the site. We may suspend service for violations.
8. Personal data. We handle personal data under Taiwan's Personal Data Protection Act and our Privacy Policy (in Chinese).
9. Changes. Changes are posted on this page with a new date and do not apply retroactively; existing purchases keep the Terms in force when they were made. We will give reasonable advance notice of changes that are unfavorable to you.
10. Disputes. Contact [email protected]; we reply within fifteen days. You may also file a complaint or seek mediation through consumer protection bodies in Taiwan.
11. Governing law. These Terms are governed by the laws of Taiwan (R.O.C.). The district court where Sumer is located is the court of first instance, without excluding the small-claims jurisdiction available to consumers by law.
12. Interpretation. Any ambiguity is interpreted in favor of the consumer.
